Tango Down - Asset Creator Terms of Service

1. Acceptance of terms

These terms apply to your use of Tango Down - Asset Creator (the "Asset Creator"), published by Kyle ("we", "us"). By using the Asset Creator you agree to these terms. If you do not agree, do not use it.

2. Description of the service

The Asset Creator is a ChatGPT plugin that helps game developers create visual references for 3D game assets, including player and character concepts, weapon concepts, props, equipment, vehicles and other game assets, along with modeling references produced as separate views. Its default visual direction is stylized realism intended for modern competitive FPS games.

The Asset Creator works inside ChatGPT. It provides instructions and a workflow; the images and text are generated by ChatGPT.

3. Eligibility

You need a ChatGPT account that is able to use plugins, and you must meet OpenAI's age and eligibility requirements for ChatGPT. If you use the Asset Creator on behalf of a company or team, you confirm that you are allowed to accept these terms for them.

4. Your responsibilities

• Use the Asset Creator lawfully and in line with these terms.
• Follow the OpenAI terms and usage policies that apply to your ChatGPT account.
• Review every result before you rely on it, and decide for yourself whether it is suitable for your project.

5. Your prompts and reference images

You are responsible for the prompts, descriptions and reference images you provide. Only upload material that you have the right to use. We do not claim ownership of anything you provide. Your prompts and uploads are processed by ChatGPT and are not sent to us; see the Privacy Policy.

6. AI-generated content

Results are produced by an AI system. They may contain errors or inconsistencies, including:

• details that differ from what you asked for,
• differences between views of the same asset,
• several views combined into one image,
• cropped subjects or backgrounds that are not transparent, and
• anatomy, proportions or mechanical details that do not make sense.

The same or similar results may be generated for other people. You are responsible for deciding whether a generated asset is suitable for your project, including whether it is accurate enough, legally clear to use and fit for production.

7. Intellectual property

The Tango Down name, logo and website, and the Asset Creator's instructions and workflow, belong to us or our licensors. These terms do not give you rights to them beyond using the Asset Creator as intended.

As between you and us, we claim no ownership of the images you generate. Your rights in generated content are determined by OpenAI's terms and by the law that applies to you. We make no promise that generated content is unique, can be protected by copyright, or does not infringe someone else's rights.

Do not intentionally ask the Asset Creator to copy or imitate third-party intellectual property, such as characters, weapon skins, logos, trademarks or artwork from existing games and brands, unless you have the right to do so.

8. Prohibited use

You agree not to use the Asset Creator to:

• break the law or infringe anyone's rights;
• create content that is illegal, sexually exploits minors, harasses or threatens people, or depicts real people without their consent;
• violate OpenAI's usage policies or try to get around its safeguards;
• present the Asset Creator or its results as an official product of, or endorsed by, a third party;
• copy, resell or redistribute the Asset Creator's instructions as your own product.

9. Availability and changes

The Asset Creator is provided when and as available. We may change, suspend or discontinue it, or any feature of it, at any time and without notice. Its availability also depends on ChatGPT.

10. Third-party services

The Asset Creator depends on ChatGPT, which is operated by OpenAI. Your use of ChatGPT is governed by OpenAI's terms and policies, and any ChatGPT subscription or fees are between you and OpenAI. We are not affiliated with or endorsed by OpenAI, and we are not responsible for ChatGPT's availability, behavior or output.

11. Disclaimers

The Asset Creator and everything generated with it are provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent the law allows. In particular, we do not warrant that results will be accurate, consistent, unique, protectable by copyright, non-infringing, production-ready or fit for any particular purpose, or that the Asset Creator will be uninterrupted or error-free.

12. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of, or inability to use, the Asset Creator or any generated content. Nothing in these terms limits liability that cannot be limited by law.

13. Termination

You can stop using the Asset Creator at any time. We may restrict or end access to it, where we are able to, if these terms are breached or if the Asset Creator is discontinued. Sections 6, 7, 11 and 12 continue to apply after you stop using it.

14. Changes to these terms

We may update these terms. When we do, we will post the new version on this page and change the date at the top. Continuing to use the Asset Creator after an update means you accept the updated terms.
